SAN ANTONIO -- Romeo Alexander Duncan was arrested early Tuesday morning for a second-degree felony charge of injury to a child by omission, according to an arrest warrant affidavit. Duncan is the father of the 1-year-old baby girl who was found unresponsive in a bathtub earlier this month, SAPD said.

First responders found Rubi Duncan,1, on June 2 around 7 p.m. when they responded to a call of an infant drowning on Bentley Street. Rubi was later pronounced dead at Northeast Baptist Hospital.

According to the arrest warrant affidavit, Romeo Duncan, 21, had stepped out of the bathroom when he returned and found the baby unresponsive. Romeo then texted the baby's mother who came home and she called 911.

When police arrived they found 56 grams of cocaine, seven grams of crystal methamphetamine, and nine grams of heroin in the restroom where the baby was, according to the arrest warrant affidavit. At the time, Duncan was arrested on a first-degree felony charge of drug possession with intent to deliver.

Police seized the drugs and Romeo's cell phone, where they found text messages that showed 39 minutes elapsed from the time Romeo texted the child's mother to the time first responders arrived at the home, according to the arrest warrant affidavit.

The 14 text messages also showed that Romeo texted other people asking them to come get the drugs because police were on the way, according to the arrest warrant affidavit.

The arrest warrant affidavit says Romeo did not provide proper life savings measures, had not been trained to perform CPR, and had not attempted to call 911 after finding the baby.

Duncan told authorities he was in too much of a panic to seek help, according to the arrest warrant affidavit. He did not call out to a neighbor for help or call 911.

The district attorney's office took over the case in early June.

Duncan has previous arrests for unlawful weapon, theft and graffiti, according to Bexar County arrest records. Duncan was in jail as recently as late January 2014.
