NEAR ARNOLD, CA - The Calaveras County Sheriff's Department said Thursday a deputy shot and killed a man after the deputy had shots fired at him.

Kevin Charles Duey, 44, of Arnold was shot by Cpl. Tom Oldham just before 8:30 a.m. in theBlue Lake Springs neighborhood just east of Arnold.

The sheriff' office wrote in a news release Duey first grabbed a driver of a gas truck, while waving a gun. Later, Duey was seen firing shots in the Blue Lake Springs neighborhood before deputies were on the scene.

According to the report,Duey fired at aOldham who returned fire, killing the man.

Duey was armed with a 40 caliber semi-automatic handgun as well as a knife.

Several streets in the area were taped off Thursday while investigators searched for bullet casings.They found numerous bullet casingsand bullet holes in vehicles and surrounding houses.

Duey was on probation, wearing a monitoring device on his ankle,instead ofserving ajail sentence for a DUI charge. He was previously convicted in 1991 for obstructing/delaying a peace officer.

Oldham has been with the Calaveras County Sheriff's Department for seven and a half years.

Sheriff's officials said Duey appeared to be under the influence of something based on his behavior. Later, deputies found a meth pipe on his person.

According to policy with officer-involved shootings, the Calaveras County District Attorney's Office and sheriff's detectives are investigating the shooting.
