
ROSEVILLE, CA - A Lincoln man received a one-year suspended sentence and three years informal probation for failing to stop and fatally striking a bicyclist two years ago.
Gaspar Reyes, 44, was sentenced after being convicted of misdemeanor vehicular manslaughter without gross negligence in the death of Kathy Marie Gienger on June 28, 2007.
Reyes was charged with failing to stop his big rig before making a right turn and striking Gienger as she rode her bike in the crosswalk at Joiner Parkway and Stanmark Drive just before 7:30 that morning. Gienger, 45, the owner of the nearby Lincoln Day Spa, was killed.
Reyes' attorney said his client did not see Gienger because big rigs sit up high and have low visibility directly beneath them.
Reyes maintained he stopped but prosecutors presented ATM camera photos taken at the nearby Safe Credit Union that indicated he did not. The ATM camera recorded images at one-second intervals.
Prosecutors compared the photo record of Reyes truck with that of a van minutes earlier that showed the latter stopped for several seconds at the stop sign.
The ATM camera did not show Reyes' truck striking Gienger.
The photo record did show Reyes stopping his dirt-hauler several moments later and getting out.
Placer County Superior Court Judge Larry Gaddis also sentenced to Reyes to 100 hours of community service to be filled by talking to high school students about being a safe driver. He was also ordered to pay a $300 fine.
