
SACRAMENTO, CA - State workers have filed a third lawsuit challenging the governor's executive order to cut pay. SEIU Local 1000's lawsuit alleges that Gov. Schwarzenegger violated two sections of the state's labor code.
(See slide show)The state labor code requires employees be paid all wages on their last day of employment.
Some employees laid off by the governor's executive order have been told they will not be paid until at least August 15.
The code states that for every day the state doesn't pay an employee his or her final wages, the state must pay a penalty of one day of compensatory pay.
Tuesday, Schwarzenegger sent a letter to State Controller John Chiang identifying whose salaries would be reduced and who would be exempt. The governor spared emergency personnel, including the employees in the office of emergency services and National Guard.
