STOCKTON, CA - The Stockton Police Department says the San Joaquin District Attorney's Office is looking into an allegation City Manager Bob Deis was involved in a battery case involving an Occupy protester in front of city hall.

The incident happened around noon Thursday, according to the Stockton Police Department.

An Occupy Stockton representative said one of their participants, Diana Buettner, was writing about the Constitution in chalk on the sidewalk when Deis allegedly stepped inside her drawing and bumped her.

The police department is not investigating, citing a potential conflict of interest. Deis and the police union have been at odds in the past, with the city manager claiming the union was trying to harass him by trying by buying the foreclosed house next to his.
